Terms & Conditions

The following Terms and Conditions constitute an Agreement (hereinafter called "Agreement") between Klimb News Wire, the "Company", and you the "USER".

1. By registering for service, and the submission of content, the "Company" and USER is in agreement to following Conditions and Terms of Service.

2. Services may be withheld or denied from any account that is unpaid. The "Company" reserves the right to deny any and all services to any company, entity or person.

3. You acknowledge and understand that the paid services to the "Company" are non refundable under any circumstances unless services or products are not rendered by us. After successful payment and display of any paid press release or any other paid product or service, on the Klimb News Wire, no refunds will be issued.

4. You, the USER agrees, understands and acknowledges that the "Company" will not accept or publish any press release that contains pornographic content, female escort services, content promoting the 'sex industry', the advocation or call for violence, terrorism, hatred, prejudice, racism or any other socially unacceptable topic.

5. The "Company" will make every effort to disseminate all press releases quickly, equally and fully within the capabilities of the site. The "Company" will make every effort to display all USER submitted press releases and content as accurately as possible as submitted by the USER. Any inadvertent errors on the part of the "Company" will be corrected upon notice from the USER without additional charge or delay.

6. The "Company" reserves the right to refuse and unpublish content, press releases or any other media deemed to be spam.

7. You the USER are responsible for the content submitted to the site and the accuracy of the content submitted. The "Company" will not investigate or verify the information contained within any content that is submitted. The "Company" will not be held responsible for any misrepresentations, factual errors or false claims that you the USER submit. The USER will bear any and all responsibility for any harm created by the submission of fraudulent, erroneous or misrepresented information contained within any content that the USER submits. The USER guarantees the following. (1) that the USER has all rights and privileges to the information submitted to the site. (2) The USER will comply with all applicable laws, rules and regulations, including but not limited to the Children's Online Privacy Protection Act of 1998 and laws relating to spam. (3) The USER or any representatives of the USER will not submit any copy, content or press releases that contain the following: slanderous material, content that is libelous, defamatory, obscene, false and misleading or which infringes upon copyright laws. The "Company" shall be held harmless by any USER who violates this section and shall be indemnified by the USER against any liability, damages, costs, losses and any other expenses related to the USER breach of the Terms & Conditions.

8. The "Company" reserves the right to at any time refuse, deny, delete or reject any content or information submitted to the site at the sole discretion of Klimb News Wire. The USER understands that there is no guarantee that the content or information that the USER submits will be disseminated by the site. Copy, content or information that is found to violate the 'publishing guidelines' or copy, content or information that is found to be less than "newsworthy" will be subject to disapproval, deletion, rejection and/or removal without notice to the USER.

9. The "Company" will not endorse or approve of any content, press release or information that promotes offers to buy or sell any securities. Nor will the USER make use of stock market ticket symbols of other publicly traded companies without the permission of the company thereof. The USER shall not promote any publicly traded company in any way that attempts to influence the price of the stock in any way. In the event that a USER mentions or uses the ticker symbol of another company, the USER must be able to provide proof of consent from the other company upon demand from Klimb News Wire.

10. The USER agrees to supply contact information with each press release. The USER will provide a name, phone number and email address so as to be the source of the information provided. Contact information is important to identify the person responsible for the press release itself.

11. The "Company" makes no guarantees or warranties as to the performance of the site or of press releases. The "Company" cannot guarantee the availability of the site, errors, interruptions, delays or losses. The "Company" shall issue refunds to the USER if the "Company" fails to provide the agreed upon services.

12. The "Company" will not guarantee any particular placement of any press release. All press releases will receive equal placement according to the site guidelines. The "Company" will provide upon request, information pertaining to any press release to media sources.

13. You, the USER agree to receive and be contacted by Klimb News Wire. The contact or communications may be via email, telephone or by postal mail. Your contact information may be used to communicate pertinent information regarding your account, press releases or mandatory information required by law.

14. The User agrees that all necessary permissions have been obtained from any companies or persons mentioned within the information, content or press releases that are submitted to the site.

15 The User shall not submit any press release, content or information pertaining to a lawsuit or litigation without first forwarding such information to Klimb News Wire.

16. The Klimb News Wire does not and cannot guarantee a press release search rankings or results with third party search engines such as Google. Many factors such as relevancy and unique content may affect how a press release appears in search engine results.

17. As the "Company" reserves the right to deny, delete, disapprove or reject certain press release, the "Company" shall not be held responsible or liable for lost business opportunities.

18. The User understands that a free press releases may not be included in site feeds or receive the same distribution as paid press releases. The USER understands that once a free press release is submitted that it may reach other web sites and may not be able to be recalled or retracted if the USER request removal.

19. You the USER understand that YOU and Klimb News Wire are separate and independent entities. Under no circumstances, the USER should assume a joint venture, partnership, employment agreement or any other type of a business relationship.

20. Should the USER violate the Terms and Conditions, Klimb News Wire reserves the right to pursue any and all legal and equitable remedies against you, including, without limitation, terminating any and all user accounts on any and all of the Klimb News Wire network web sites.

21. The USER cannot delete, retract, redact, remove, unpublish or edit any press release once submitted, accepted or published on the news wire. It is the USER's responsibility to ensure that the information submitted to the news wire is accurate, complete and whole prior to submission. The news wire does not investigate the validity or claims made within press release but does reserve the right, at its discretion, to unpublish content that is learned to violate sections of the Terms and Conditions.
